1. Acceptance of Terms

By accessing or using the APEX System platform (the "Service") operated by APEX Growth Partners, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service.

2. Description of Service

APEX System is an all-in-one CRM and automation platform built for Medicare insurance agencies. The Service includes CRM functionality, AI-powered follow-up automation, workflow automation, annual review campaigns, phone and email service, calendar scheduling, reputation management, and compliance tools. Setup, data migration, and onboarding are included with all plans.

3. Pricing and Payment

We offer two payment paths:

  • Setup Fee Path: $1,997 one-time setup fee + $297/month, billed monthly. Month-to-month with no long-term commitment. Cancel anytime after 90 days. Backed by a 90-day money-back guarantee.
  • No Setup Fee Path: $0 setup fee + $297/month with a 12-month commitment. Prepay annually and receive 2 months free ($2,970/year instead of $3,564/year).

All plans include a 30-day implementation window. Monthly billing begins after implementation is complete.

4. 90-Day Money-Back Guarantee

If you choose the Setup Fee Path and APEX System does not deliver for you within the first 90 days, we will refund your setup fee. To request a refund, contact us at mike@apexgpartners.com. The guarantee applies only to the Setup Fee Path and does not apply to the No Setup Fee Path.

5. Your Responsibilities

  • You are responsible for the accuracy of data entered into the platform.
  • You must comply with all applicable Medicare marketing regulations, including CMS guidelines.
  • You are responsible for obtaining necessary consents from your clients for communications.
  • You must not use the Service for any unlawful purpose or in violation of any applicable law.

6. HIPAA and Data Protection

APEX System is HIPAA compliant. We implement appropriate safeguards to protect Protected Health Information. Business Associate Agreements are available upon request. You are responsible for ensuring your use of the Service complies with HIPAA and other applicable healthcare privacy regulations.

7. Intellectual Property

The Service, including all software, templates, campaigns, and content, is the property of APEX Growth Partners, LLC. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written consent.

8. Limitation of Liability

APEX Growth Partners, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid for the Service in the 12 months preceding the claim.

9. Termination

You may cancel your account at any time after 90 days (Setup Fee Path) or after the 12-month commitment (No Setup Fee Path). We may terminate or suspend your account for violation of these Terms or for unlawful use of the Service.
